Purchase conditions
The prices and conditions of sale are purely informative and may be modified due to market fluctuations. However, placing the order by filling out the purchase form implies agreement with the offered price and the general conditions of sale in force at that time, except for orders for products that due to a human or computer error have a price below cost, and orders with no stock, which will be automatically rejected by Cerveza SanFrutos.
All orders placed directly by a user through the website must be reviewed and expressly accepted by Cerveza SanFrutos; the customer will receive an email indicating their acceptance or rejection. Once the order is confirmed, the purchase will be understood as formalized and fully perfected, with all the legal guarantees that protect the acquiring consumer. From that moment on, the prices and conditions will have a contractual nature and cannot be modified without the express agreement of both parties.
Spanish will be the language used to formalize the contract. The electronic document in which the contract is formalized will be archived and the user will have access to it in their customer area.
Warranties
Cerveza SanFrutos guarantees all its products in accordance with current consumer legislation. The consumer can address both the seller and the manufacturer of the product, who will answer for the lack of conformity that becomes apparent within a period of two years from delivery.
If the defect comes to light during the first 6 months from the delivery of the good, it is presumed, unless proven otherwise, that the anomaly already existed when the purchase was made. When the lack of conformity becomes apparent after 6 months, Cerveza SanFrutos may request additional information to process the warranty.
The consumer may file a claim when the product is not in conformity with the contract, in particular when:
- The acquired good does not match the description provided by the seller.
- The acquired good is not suitable for the uses to which products of the same type are ordinarily intended.
- It does not present the expected quality and performance, especially considering the public statements about its specific characteristics.
The consumer has the right to the repair or replacement of the product, and where appropriate, to a price reduction or termination of the contract, in accordance with the provisions of current consumer protection regulations.
Voiding of warranties
The warranty may be voided for the following reasons:
- Incorrect use, handling, or conservation of the product by the customer.
- Natural deterioration of the product due to the passage of time or inadequate storage conditions.
- Damage caused by external causes unrelated to the product.
No damaged material or material with obvious signs of incorrect handling will be accepted.
The warranty does not cover
The warranty does not cover defects caused by incorrect use or conservation of the product. In these cases, the consumer must bear the cost of its repair or replacement. Likewise, the warranty will apply regarding hidden defects and manufacturing defects of the product in accordance with Article 1490 of the Civil Code.
Cancellations and returns
Order cancellations that involve a refund to the customer and are made by bank transfer will have a maximum period of 30 days due to administrative procedures, although we try to ensure the timeframe does not exceed 7 days.
Delivery and shipping costs
Shipping costs for the Peninsula (national territory) are calculated based on the weight of the order via DHL carrier:
- From 0 to 1 kg: €7.10
- From 1 to 2 kg: €7.10
- From 2 to 3 kg: €7.90
- From 3 to 4 kg: €8.10
- From 4 to 5 kg: €8.35
- From 5 to 10 kg: €10.00
- From 10 to 15 kg: €11.35
- From 15 to 20 kg: €12.90
- From 20 to 25 kg: €15.05
- From 25 to 30 kg: €17.25
- From 30 to 40 kg: €21.55
- From 40 to 50 kg: €25.75
- Orders from €48.00: FREE
Shipments are not made to the Canary Islands, Balearic Islands, Ceuta, and Melilla. For shipments outside the national territory, please consult specific conditions at info@cervezasanfrutos.com.
General delivery conditions
Once the order is confirmed and the full amount is paid, it will be processed and shipped to the provided delivery address within approximately 48/72 hours. Cerveza SanFrutos will make every effort to meet the indicated delivery time, informing the customer of any circumstance that could affect the usual delivery period.
Because the Cerveza SanFrutos online catalog may consolidate locally decentralized products, it could happen that, in orders of more than one product, several shipments are made and therefore partial deliveries are carried out until the order is completed.
In the case of orders containing products with different delivery times, Cerveza SanFrutos will by default process the shipment when all products are available. The customer may request a first shipment with the available products and a second one when the remaining products become available, assuming in this case the additional cost of the second shipment.
At the time of delivery, you must carefully verify the condition of the merchandise and the number of packages according to the carrier's delivery note. In the event of errors or visible damage, it is important to record this on the carrier's delivery note and notify Cerveza SanFrutos and the transport agency within 24 hours in writing to info@cervezasanfrutos.com.
Important: Claims filed after 24 hours of delivery cannot be accepted.
Cerveza SanFrutos shall not be liable for damages that may arise from the delay or lack of delivery of the merchandise, especially for loss of profits or any consequential damage that, as a consequence of the delay, the customer might suffer.
